These Terms of Service (“Terms”) govern access to and use of the AikFlow website, waitlist, and, once available, the AikFlow club hub and mobile application (together, the “Service”), currently operated by the AikFlow founding team on behalf of C-COPRS, a company currently being incorporated in Madagascar to hold and operate the AikFlow product and brand.
AikFlow is currently in a pre-launch pilot phase. Joining the waitlist does not guarantee access to the Service; selected clubs will be contacted directly for onboarding. Features described on the website may evolve before general availability, and this notice will be updated once C-COPRS's incorporation is finalized.
The Service is intended for amateur sports clubs, coaches, athletes, and their families. Creating an athlete account for a minor requires explicit, verifiable consent from a parent or legal guardian, obtained through AikFlow's consent module before any account activation. Account holders are responsible for keeping their login credentials confidential and for all activity under their account.
You agree to use the Service only for its intended purpose — club management and individualized athlete coaching — not to attempt to access other users' data without authorization, and not to use the Service in any unlawful or harmful way, or in a way that infringes the rights of others.
AikFlow's posture and wellness features are a coaching aid, not a substitute for a qualified physical trainer, physiotherapist, or medical professional. AikFlow does not provide any medical diagnosis and does not prescribe any treatment. All AI-generated suggestions remain under the control and validation of the club's coaching staff, who are responsible for decisions affecting athletes.
The Service, including its software, design, trademarks, and content, is the property of C-COPRS (in formation) or its licensors. These Terms grant you a limited, non-transferable, non-exclusive right to use the Service as intended; they do not transfer any other intellectual property rights.
Use of the Service is subject to our Privacy Policy, in particular regarding the on-device processing of movement data and the requirement of parental consent for minors, in line with Malagasy Law n°2014-038.
We aim to keep the Service available and reliable but do not guarantee uninterrupted access, and may modify, suspend, or discontinue all or part of the Service, including during the pilot phase, giving reasonable notice where possible.
To the maximum extent permitted by applicable law, C-COPRS (in formation) and its founders shall not be liable for indirect damages arising from the use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under Malagasy law.
You may stop using the Service and request deletion of your data at any time by contacting us. We may suspend or terminate access in case of a material breach of these Terms.
These Terms are governed by the laws of Madagascar. In the event of a dispute, and after an attempt at an amicable resolution, the competent courts of Madagascar, in particular the courts of Antananarivo, shall have jurisdiction.
We may update these Terms as the Service and the incorporation of C-COPRS evolve. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms; material changes will be communicated by email to registered users.
